Visit-France.org, as an intermediary, supports visitors and tourist activity providers on this online booking platform. Additionally, Visit-France.org, through this online platform, also allows certain cooperation partners (sub-intermediaries/cooperation partners) to book tourist activities provided by the supplier. The use of this online booking platform by a sub-intermediary or partner implies a contractual agreement for which Visit-France.org has previously given its written consent. Contracts related to tourist activities are concluded directly between the users of this online platform and the tourist activity providers. When users book through a partner platform or when a sub-intermediary makes a booking on behalf of a user of a partner platform, a special contract between the user and the supplier is directly formed. Visit-France.org is not a party to the contract regarding the tourist activities offered through this online booking platform.
1. Terms of Use for the Visit-France.org Website and the Visit-France.org Application
Who is the operator?
The lower parts and contents, such as texts, images, videos, services provided, as well as all other information contained therein, constitute the entire website. You can contact the Visit-France.org company by email at (https://www.Visit-France.org/contact).
Bookings made on the booking platform are subject to the general terms and conditions of the Visit-France.org company as well as the general terms and conditions of the tourist activity providers.
Scope of Application of the Terms of Use
These terms of use (the “Terms of Use”) apply jointly with the data protection statement (“data protection provisions”) for all forms of use. The use of the website requires each visitor (“user” or “you”) to accept the terms of use as well as to read and understand the data protection directive. Full or partial use of the website means that you have carefully read and understood these terms of use and the data protection statement. It is mandatory that you agree to all provisions of these terms of use.
All data shared on this website is informational in nature. This information cannot constitute a legally binding offer from our company. A binding contract is only concluded with the tourist activity providers presented on our site through a booking request on our online platform, which the provider accepts according to our general terms and conditions.

Limited Authorization for the Visit-France.org Application
Visit-France.org hereby provides the Visit-France.org application to you. This application grants you a non-exclusive, non-transferable, non-sub-licensable, revocable, royalty-free, worldwide right, subject to compliance with these terms of use from this day forward and in the future. The Visit-France.org application may be used exclusively in object code format for personal purposes (if you are a consumer) or for internal commercial purposes (if you are a business). The number of copies and backups of the Visit-France.org application that can be made must not exceed the legally required usage. Third parties are prohibited from copying, adapting, redeveloping, decompiling, disassembling, modifying, adjusting, or attempting to partially or fully correct errors in the Visit-France.org application. Renting, sub-licensing, translating, merging, adjusting, and modifying the Visit-France.org application are prohibited. Disassembling, decompiling, reverse engineering, or using the source code partially or entirely as the basis for other programs, including any attempts of such activities, is prohibited.
Intellectual Property Rights

Applicable Law and Competent Court
The law of the French Republic applies, and the United Nations Convention on Contracts for the International Sale of Goods does not apply. If you use the site as a consumer and your habitual residence is in another state at the time of use, the choice of applicable law mentioned in the first sentence does not affect the application of mandatory norms from that other state. Local courts have exclusive jurisdiction, provided that the user is a merchant under the French Commercial Code or has no permanent residence in France at the time of the legal proceedings. 2. Visit-France.org – General Terms for the User Regarding All Offers on the Online Platform Visit-France.org
Introduction
1.1 Visit-France.org operates an intermediary platform for offers related to tourist activities. The platform of Visit-France.org offers online services through its website and applications. The website and its applications are collectively referred to as the “Visit-France.org platform” in these general terms. Users can find and book tours, activities, and adventures across France on the Visit-France.org platform. All offers presented on our online platform include guided tours, cooking classes, bus tours, canal tours, tickets for tourist attractions, and much more. These offers are published online by a variety of local providers across France (“providers”), with whom the respective service agreement is made (“service contract”). Information regarding the services provided by the providers can be found on the Visit-France.org platform, where bookings can also be made.
1.2 Visit-France.org addresses both consumers and professionals. For the purpose of these terms and conditions, the following definitions apply: A “consumer” is any individual who enters into a contract for a purpose that is predominantly unrelated to their commercial or professional activity. A “professional” is any individual or legal entity, or partnership acting in the course of their commercial or professional activity when entering into a contract. A “user” is any individual unless they are specifically registered as a legal entity with Visit-France.org. Use by action or omission under the registration of a legal entity is attributed to the individual unless acting as an agent for the legal entity. Sub-intermediaries are also considered “users” in this context.
Scope of Part II of These General Terms
These general terms apply to all uses of the Visit-France.org platform, whether via the website or the applications. The contractual relationship between the user and Visit-France.org is primarily limited to the proper mediation of users with the respective providers or the transmission of user data from a sub-intermediary. Visit-France.org is not the organizer and does not act as the lessor, seller, or contractual partner regarding the service contract made with the user. Part II of these general terms applies to the offers available on the Visit-France.org platform and to the mediation of users with the providers. This section also applies to the use of the Visit-France.org platform by cooperation partners (sub-intermediaries/cooperation partners), subject to the specific contractual agreements with the respective partner. The terms of the specific service contract between users and providers are governed by Part III of these general terms.
Registration
3.1 In principle, the use of the offers provided on the Visit-France.org platform can be done anonymously. 3.2 Certain uses of the Visit-France.org platform, such as making reservations, require registration. When registering, the user submits an electronic registration form and accepts the general terms. Registration with Visit-France.org is completed only after the user confirms their registration via email. Individuals who have reached the age of 18 are permitted to register. The user is obligated to keep their password confidential and take reasonable precautions to prevent third-party access. 3.3 Creating multiple user accounts for the same individual or legal entity is prohibited. The user account is non-transferable.
Services of Visit-France.org / Conclusion of the Contract
4.1 After entering their preferences on the Visit-France.org platform (e.g., destination, type of tour, start time, number of participants, price choice), Visit-France.org presents the user with provider information (“service information”). Based on this information and after checking availability, the user can submit a booking request, which will be forwarded to the respective provider. Sub-intermediaries act on behalf of the user when utilizing the mediation service. The user must add their selection to the cart by clicking on the “confirm and book” button. 4.2 The offer from the user is valid for 5 working days (cf. point 5 of Part III of the general terms for providers of tourist activities). 4.3 Visit-France.org informs users of the transport and sales conditions of the providers related to their contractual relationship with the user and their services. These conditions can be found in the respective offers. It is the user’s responsibility to comply with these conditions. The provider reserves the right to refuse users entry to the activity or exclude them if these conditions are not met. In such cases, the paid amount will not be refunded. 4.4 Visit-France.org provides users with a booking confirmation on behalf of the provider and a payment confirmation. The use of the Visit-France.org platform is generally free. The user bears the costs related to technical access to the platform (e.g., internet access). Visit-France.org is authorized to collect the amount specified by an invoice on behalf of the provider. 4.5 Visit-France.org transmits any relevant data to the user regarding the use of services from the provider in accordance with the applicable conditions (e.g., ticket details), once received from the provider. 4.6 Visit-France.org does not guarantee the relevance of the transmitted data or the quality of services provided by the providers since all information shared and transmitted comes from the providers or third parties, which Visit-France.org cannot verify in detail.
Payment at Visit-France.org
5.1 The payment the user must make for services provided by the provider is governed by the service contract concluded with the provider. 5.2 Visit-France.org is authorized to collect the amounts specified in the invoice on behalf of the provider, unless otherwise stated on the invoice. If the user needs to pay in a currency different from their own (foreign currency claim), Visit-France.org may require the user to make payment in their local currency and convert the foreign currency claim at the current exchange rate at the time of contract conclusion. Visit-France.org may charge the user a reasonable currency conversion fee. 5.3 The interlocutors of the user regarding the service contract and its payment are the provider’s contractual partner. The user can only request a refund from the respective provider. Refunds from the provider may also be processed through Visit-France.org. For user convenience, it is advised to make communication via Visit-France.org. 5.4 The user must log in to use the cash payment option. The user must provide accurate payment information and update any changes immediately. Visit-France.org may refuse the payment method chosen by the user. The available payment methods for the respective service will be presented to the user during the booking process. 5.5 By agreeing to pay, the user consents to their payment information being used by the creditor for payment collection. Visit-France.org reserves the right to condition the use of the Visit-France.org payment function upon verification of the user’s creditworthiness.
Visit-France.org Pricing Structure
6.1 All prices displayed on Visit-France.org are set by the providers and are subject to their own general terms and conditions of sale. 6.2 These prices set by the providers may be subject to specific provisions related to cancellations and refunds for payments made. Please ensure you carefully review the specific service contract for any such provisions before making a reservation.
Best Price Guarantee by Visit-France.org
7.1 Visit-France.org aims for users to pay the lowest possible price for the respective service. If a user finds the same offer (same city, number of participants, availability) at a lower price on the internet, Visit-France.org will unilaterally and voluntarily refund the difference between the price booked through Visit-France.org and the lowest price found online by the user. 7.2 All special offers and promotions are qualified as such.
User’s Duties and Obligations
8.1 The user is required to keep their registration data (username and password) confidential and not allow third parties to access their Visit-France.org account using this data. Any use of the user’s account on the Visit-France.org platform will be attributed to the user. 8.2 After receiving information about the services, the user may send reservation requests to Visit-France.org to be redirected to the provider. 8.3 The user agrees to indemnify Visit-France.org from any claims made by third parties due to their use of the Visit-France.org platform unless those third parties are represented by Visit-France.org.
Availability and Warranty
9.1 Availability, quality criteria, features, or technical support for the Visit-France.org platform are not guaranteed. Visit-France.org may at any time and freely restructure, reduce, or adjust the platform. Existing agreements between the user and the provider, and their arrangements, are not affected by such changes. 9.2 Visit-France.org does not guarantee the relevance or completeness of the data provided by third parties (e.g., other providers). 9.3 Visit-France.org does not guarantee the services offered by providers. The respective provider is the contact person for the user regarding inquiries and claims.tions relatives au contrat de prestation ainsi que de son exécution.

Liability of Visit-France.org
10.1 As long as Visit-France.org has not explicitly agreed to a contractual obligation with the user, it does not assume responsibility for any booking request made by the user with the intention of entering into contracts with the service provider facilitated by the intermediation. 10.2 Without explicit agreement or guarantee in this regard, Visit-France.org does not assume responsibility for services facilitated by the intermediation. Visit-France.org also does not assume responsibility for any breaches of the service obligation or for bodily or material damage caused to the user in connection with the services facilitated by the intermediation. 10.3 Any potential liability of Visit-France.org for violating obligations related to contract intermediation is not affected by the provisions outlined above. 10.4 The liability of Visit-France.org for the user’s contractual obligations is limited to three times the price of the tourist activities facilitated by the intermediation, except in the following cases: • Any violation of an essential obligation, the fulfillment of which allows the contract to be executed in accordance with its purpose, or which affects the purpose of the contract. • Liability for injury to life, physical integrity, or health caused by the user, based on negligence by Visit-France.org, or intentional or negligent violations by a legal representative or an auxiliary of Visit-France.org. • Liability for other damage caused by the user arising from a violation of Visit-France.org’s obligations due to gross negligence, or from intentional or negligent violations by a legal representative or an auxiliary of Visit-France.org. 10.5 In the case of simple negligence, Visit-France.org is only liable for the violation of an essential obligation of the contract, and only for foreseeable and typical damages. Essential obligations are those whose fulfillment is necessary for the proper execution of the contract and upon which the user may rely. 10.6 Liability limitations do not apply in the case of a warranty transfer, for injuries to life, bodily harm, and health, as well as for provisions guaranteed by the German Product Liability Act.
Termination
Users may terminate their registration on the Visit-France.org portal at any time by blocking their user account. Visit-France.org may unilaterally terminate a registration within a week. Claims arising prior to this termination remain unaffected. The right to extraordinary unilateral termination is not affected.
Evaluation Function
12.1 Users have the possibility to influence the content displayed on the Visit-France.org platform. Users can write travel stories in the form of reviews or image adjustments (“user content”). Users are responsible for the user content they have adjusted in full and guarantee its accuracy. They ensure that the content does not contain any false or inadmissible statements or data. Users guarantee that their content does not infringe upon the rights of any third party. Visit-France.org is in no way responsible for user content but simply provides a platform. 12.2 Visit-France.org may use user content in various ways, including displaying it on the website, restructuring, refining it for clarity and better grammar, integrating advertisements, or involving other service providers. 12.3 Visit-France.org may freely delete or adjust user content as needed. For example, it may remove user content if it violates the principles of Visit-France.org. Visit-France.org is not obligated to store or make copies of user content available. It does not guarantee the confidentiality of user content. 12.4 Visit-France.org, its sub-intermediaries, and their associates (commercial partners) may display advertisements and additional information alongside user content on the website and may also display additional media. Users are not entitled to any compensation for such advertisements. Modifications regarding the nature and scope of such advertising measures are reserved, and users do not need to be specially notified. 12.5 Users exempt Visit-France.org from all claims made by third parties in their entirety (including reasonable costs related to the exercise and defense of a right) upon first request, arising from user content adjusted by the user in relation to Visit-France.org. This applies even if the contentious content displayed on the platform is no longer available. This does not apply if Visit-France.org is responsible for a violation of the law. Users must immediately and truthfully provide Visit-France.org with all necessary information regarding the claims and defense when a third-party claim is made.
Data Protection
13.1
Visit-France.org collects and uses users’ personal data when necessary for the establishment and modification of the contractual relationship between the user and Visit-France.org.
13.2
When Visit-France.org is involved in communication for a service contract between the user and the respective service provider it sends the necessary data to the respective service provider. The service provider processes and uses this data for the creation and conclusion and and execution of the contract solely under their responsibility. The identity of the respective service provider is disclosed in the booking dialogue.

Modification of these Terms and Conditions
14.1
Visit-France.org reserves the right to modify these terms and conditions at any time and without providing a reason. Any modifications will be communicated to consumers and the user is required to accept them considering the interests of both parties. This includes situations such as a violation of equivalence, regulatory gaps, and changes in legal circumstances. Modified terms will be sent to users by email no later than two weeks before they come into effect. If a user does not contest the validity of the modified terms within two weeks of receiving the email, the modified terms are considered accepted and therefore applicable. Visit-France.org will specifically inform users in the email about the significance of this two-week period.
14.2
The terms and conditions may be modified at any time and without prior notice to accommodate subsequent uses in the intermediation. The new valid terms will apply to each intermediation.
Other Conditions
15.1 These general terms and conditions constitute the sole agreement between Visit-France.org and the user. No other arrangements exist. 15.2 The law of the French Republic applies, and the United Nations Convention on Contracts for the International Sale of Goods does not apply. If you have made the booking as a consumer and your usual residence is in a different state at the time of booking, the choice of applicable law stated in the first sentence does not affect the application of the mandatory provisions of that other state. The courts in Berlin have exclusive jurisdiction if the user is considered a merchant under the French Commercial Code or does not have a fixed domicile in France. This does not affect the courts considered mandatorily competent by law. 15.3 If any provisions of these terms and conditions should be or become invalid, the remaining provisions will not be affected.
3. General Terms and Conditions of the Tour and Other Tourist Activity Providers
Introduction
Part 3 of these general terms and conditions applies to all contracts concluded between the service provider and the users via the Visit-France.org platform. This also applies when access to the Visit-France.org platform is made through a partner platform of a cooperation partner or through its intermediary or via the platform of a sub-intermediary.
True Data
The data provided via the Visit-France.org platform must be truthful. The service provider reserves the right to withdraw from the contract or exclude the user from participation in a service and claim damages equivalent to the cancellation fees in accordance with section 11 of Part II of these general terms and conditions, if the user has provided incorrect data.
Arrival at the Meeting Point and Compliance with Conditions
Arriving on time at the communicated meeting point is your responsibility. You are also responsible, if you arrive for the activity from abroad, for bringing the necessary travel documents (passport, etc.) and complying with health-related provisions, etc.
Additional Participation or Transfer Conditions
To the extent that the service provider agrees with you on additional participation or transfer conditions beyond the general contractual conditions outlined in this Part III, you are solely responsible for complying with these additional participation or transfer conditions. The service provider reserves the right to exclude any participant from the activity who does not meet these conditions.
Binding Nature of the Request
The contract between you or rather between the user benefiting from the intermediation and the service provider is concluded by the acceptance of your binding request by the service provider. By booking a tour or another activity, you submit a binding offer to the service provider, which you or the user benefiting from your intermediation are committed to for 5 working days. If the service provider accepts your offer within this period, a binding contract is formed. You or the user benefiting from the intermediation will receive this confirmation by email.
Payment
The total agreed price for the service facilitated by Visit-France.org becomes due upon the completion of the contract, i.e., upon payment.
Right of Withdrawal
The service provider informs that the right of withdrawal is not provided under the statutory provisions for contracts related to tourist services concluded at a distance (i.e., via the Visit-France.org platform). Only the rights of termination and cancellation provided by French law are applicable.
Responsibility for Insurance
The price of the services does not include any insurance. It is your sole responsibility to obtain sufficient insurance. The necessity for insurance varies depending on the reserved activities.
Unpaid Services
If you or the user benefiting from your intermediation does not pay for the reserved service in accordance with the agreed payment deadlines, while the service provider is ready and able to provide the services as per the contract and no legal or contractual right of retention exists on your part or the part of the user benefiting from your intermediation, the service provider is authorized, after a payment reminder with a deadline, to withdraw from the contract and charge you or the user benefiting from your intermediation for the cancellation fees as outlined in section 11.
Message Exchange
All messages between you or the user benefiting from your intermediation and the service provider take place via the Visit-France.org platform. For faster processing, it is advised to use only the forms provided by Visit-France.org.
Cancellation Guidelines
11.1 When you cancel (withdraw) from the activity, the cancellation conditions mentioned in the product description and on your voucher apply. Visit-France.org advises the user to carefully read the information contained in the product description.
11.2 If the product description of your service provider does not mention any specific cancellation conditions, the cancellation fees of the tourist activity provider are as follows:
– Up to 96 hours before the start of the activity, a full refund.
– After 96 hours before the start of the activity or in the case of a no-show, no refund.
11.3
You or the user benefiting from your intermediation must always provide proof to the service provider that no damage has been caused or that only a minor damage lower than the fee required by the provider has been caused.
11.4
The service provider reserves the right to claim a higher compensation instead of the previous fixed fee if the provider proves that costs significantly higher than the applicable fee have been incurred. In this case the provider is committed to quantifying the compensation claimed taking into account saved costs and any alternative provision of services and to providing proof.
11.5
The refund will be made using the same payment method as previously used. For credit cards incurring monthly fees the amount will be credited at the end of the current billing period. The refund date depends on the credit card agreement with the user. Refunds via bank transfer are made within seven working days.
Extraordinary Cancellation
The service provider may cancel the scheduled appointment for the activity without respecting the cancellation deadline when weather conditions, administrative regulations, strikes, or other unforeseen or unavoidable external circumstances (particularly force majeure events) prevent or significantly complicate or endanger the execution of the activity. In this case, the price paid will be refunded.
Exclusion from Participation
The service provider may refuse you access to an activity or exclude you if you do not meet the participation requirements, if your participation would put you or others in danger, or if your participation would otherwise substantially disturb the smooth running of the activity. This also applies to the user benefiting from your intermediation. In this case, no refund will be provided for the price paid.
Program Modifications
The service provider also reserves the right to make incidental changes to the program when such decisions are made due to unforeseeable or unavoidable circumstances.
Other Conditions
You will find other conditions or exceptions in the respective calls for tenders.
Time Zone
The service provider’s time zone is authoritative for setting the times and deadlines.
Responsibility of the Tour or Tourist Activity Provider
The service provider is responsible for their services in accordance with the applicable law. The service provider is only liable when such liability is provided by the applicable law.
Modification of These General Terms and Conditions
The general terms and conditions of the tour or other tourist activity providers may be changed at any time and without prior notice for future bookings. The current terms apply to each individual booking. The user cannot claim that the terms previously applied to later bookings.
